Welcome to Empress English.

These Terms & Conditions govern the use of the Empress English website and the booking and purchase of one-on-one online English lessons provided by Cagri Adal.

By booking a lesson, purchasing a lesson package, or using the Empress English website, you acknowledge that you have had an opportunity to review these Terms & Conditions and the other policies applicable to the relevant service.

These Terms & Conditions are subject to applicable Turkish legislation, including mandatory consumer protection and personal data protection requirements.

1. About Empress English

Empress English provides one-on-one online English lessons through live virtual sessions and related lesson materials.

The lessons may include general English, Business English, pronunciation practice, IELTS preparation, TOEFL preparation, interview English, and other English-language learning areas described on the website.

2. Acceptance of These Terms

By booking a lesson, purchasing a lesson package, or using a paid Empress English lesson service, you agree to these Terms & Conditions and the policies applicable to that service.

These may include:

• The Cancellation & Rescheduling Policy;

• The Refund & Credit Policy;

• The Privacy Policy / KVKK Information Notice;

• The Cookie Policy;

• The Accessibility Statement; and

• The Code of Conduct.

If you are under 18 years of age, a parent or legal guardian must make the booking and accept these Terms & Conditions on your behalf where required by applicable law.

3. Booking One-on-One Online Lessons

Lessons may be booked through the Empress English website or through another booking method made available by me.

A paid booking is generally confirmed when:

• Payment has been successfully completed through PayTR, where payment is required at the time of booking; or

• I have provided written confirmation of the booking where payment is arranged separately.

Students are responsible for providing accurate booking and contact information.

4. Free Trial Lesson

I offer one complimentary 30-minute Trial Lesson & Placement Assessment to eligible new students.

The purpose of the trial lesson may include:

• Assessing the student's approximate English level;

• Discussing English-learning goals;

• Identifying learning needs;

• Recommending an appropriate lesson structure; and

• Allowing the student to experience my teaching approach before purchasing paid lessons.

Only one free trial lesson is normally available per new student.

I may decline or cancel a trial booking where there is reasonable evidence that the same individual has previously completed a trial lesson or where the booking is being used improperly.

The free trial does not create an obligation to purchase paid lessons.

5. Payment

Payments for one-on-one online English lessons and lesson packages may be processed through PayTR.

Prices displayed on the website will identify the applicable currency and, where required, applicable taxes or other charges.

Unless otherwise agreed in writing, payment for a paid lesson or lesson package must be completed before the relevant lessons begin.

I do not normally collect or store complete credit or debit card details on my own systems.

Payment information may be processed by PayTR in accordance with its own terms, privacy practices, security procedures, and applicable legislation.

6. Prices and Service Information

I make reasonable efforts to ensure that lesson descriptions, prices, lesson durations, package contents, and other information published on the website are accurate.

However, occasional errors or changes may occur.

The applicable price and lesson terms will be those presented to the student at the time of purchase, subject to applicable law.

I may update prices and introduce or discontinue lesson arrangements for future bookings.

A price change will not retroactively alter the price of a lesson or lesson package that has already been purchased, except where permitted or required by applicable law.

7. Cancellations and Rescheduling

Students may cancel or reschedule a scheduled lesson without losing the lesson by providing at least 24 hours' notice before the scheduled lesson start time.

Requests made with less than 24 hours' notice will normally be treated as late cancellations and the lesson may be deducted from the student's lesson package or treated as a used lesson.

Missed lessons without the required notice will normally be treated in the same manner.

Nothing in this section limits mandatory consumer rights under applicable Turkish legislation.

8. Late Arrival

If a student arrives late for a scheduled lesson, the lesson will normally still end at its originally scheduled time.

The missed portion of the lesson will not normally be added to the end of the lesson or transferred to another lesson.

If a student is more than 15 minutes late without prior notice, I may treat the booking as a no-show.

Where exceptional circumstances apply, I may consider an alternative arrangement on a case-by-case basis.

9. No-Shows

If a student does not attend a scheduled lesson without providing the required cancellation or rescheduling notice, the lesson will normally be treated as a used lesson and may be deducted from the student's package.

A no-show will normally not be eligible for a refund or replacement lesson.

Repeated no-shows may result in the suspension or cancellation of future bookings, subject to applicable law and any mandatory consumer rights.

10. Technical Issues

Students are responsible for having the equipment and internet connection reasonably necessary to participate in one-on-one online lessons, including:

• A suitable device;

• A stable internet connection;

• A functioning microphone;

• A functioning camera where appropriate;

• Access to Zoom; and

• A suitable learning environment.

If a technical problem on the student's side prevents the lesson from taking place, the lesson will normally be treated in accordance with the cancellation and no-show provisions of the applicable policy.

If a technical problem on my side prevents the lesson from taking place or makes it impossible to provide the lesson properly, I will make reasonable efforts to resolve the issue.

If the lesson cannot reasonably continue, I will reschedule the affected lesson at no additional cost or provide another appropriate arrangement in accordance with the circumstances and applicable law.

11. Lesson Packages

Where lesson packages are offered:

• Packages are intended for the student named at the time of purchase;

• Packages may not normally be shared with another person;

• Packages may not normally be transferred to another person without my prior approval;

• Lessons must normally be used before the package expiration date;

• The package price and number of lessons will be stated at the time of purchase; and

• Package validity may be extended where I approve an extension or where an extension is required by applicable law.

Package terms are subject to the Refund & Credit Policy and applicable Turkish consumer legislation.

12. Student Responsibilities

Students agree to:

• Provide accurate booking and contact information;

• Attend scheduled lessons;

• Participate appropriately in lessons;

• Make reasonable efforts to complete recommended practice;

• Follow the applicable cancellation and rescheduling procedures;

• Make payments when due;

• Use lesson materials only for permitted personal learning purposes; and

• Treat me respectfully and professionally.

Abusive, threatening, discriminatory, harassing, sexually inappropriate, or seriously disruptive behaviour is not permitted.

I may end a lesson or take reasonable action in response to serious or repeated misconduct, subject to applicable law.

13. Intellectual Property

Unless otherwise stated, lesson plans, worksheets, presentations, exercises, written explanations, videos, graphics, learning resources, website content, and other original materials created or provided by me remain my intellectual property or the intellectual property of the relevant rights holder.

Materials provided as part of one-on-one online lessons are intended for the purchasing student's personal learning use.

Students may not, without my prior written permission:

• Sell lesson materials;

• Commercially exploit the materials;

• Republish or publicly distribute them;

• Upload them to other websites or platforms;

• Reproduce or redistribute lesson content;

• Present my materials as their own; or

• Use my materials to provide lessons or training to third parties.

Students may download or retain materials where I expressly provide them for personal learning use.

This section does not restrict any rights that cannot legally be restricted under applicable law.

14. Lesson Recordings

Students may not record, reproduce, publish, distribute, or share lessons without my prior permission.

This includes audio recordings, video recordings, screen recordings, photographs, screenshots, or other forms of reproduction that capture the lesson or its content.

Any recording or processing of personal data relating to lessons will be handled in accordance with applicable data-protection legislation and my Privacy Policy / KVKK Information Notice.

15. English-Language Learning Disclaimer

I provide one-on-one online English lessons and learning support.

However, individual English-learning outcomes vary.

I do not guarantee:

• A particular level of English proficiency;

• A specific IELTS, TOEFL, or other examination score;

• Admission to a school, university, college, or other institution;

• Employment or career advancement;

• Visa or immigration approval;

• Success in an interview;

• Success in a professional examination; or

• Any other specific educational, professional, immigration, or personal outcome.

Any examples of results, scores, progress, or student experiences presented by Empress English are illustrative and should not be interpreted as guarantees.

16. Immigration, Legal, and Professional Information

Any immigration-related English materials, interview preparation, vocabulary, communication exercises, or similar content provided by Empress English is intended solely for English-language learning purposes.

I do not provide legal, immigration, financial, medical, employment, academic-admissions, or professional licensing advice.

Students should consult the relevant government authority or an appropriately qualified professional when they require advice concerning their individual circumstances.

17. Third-Party Services

Empress English may use third-party services to provide or support one-on-one online lessons.

These may include:

• PayTR, for payment processing;

• Zoom, for one-on-one online lessons;

• Website hosting and website-management services;

• Booking and scheduling services;

• Email and communication services; and

• Analytics or other technical services.

Third-party services operate under their own terms and privacy policies.

I am not responsible for matters outside my reasonable control relating to third-party services, including their independent technical failures, policies, availability, or changes to their services.

18. Website Availability

I make reasonable efforts to maintain the Empress English website and booking system.

However, the website may occasionally be unavailable because of:

• Maintenance;

• Technical problems;

• Hosting or internet problems;

• Third-party service interruptions;

• Security incidents; or

• Other circumstances beyond my reasonable control.

I do not guarantee uninterrupted or error-free website availability.

19. Privacy and Personal Data

Personal data collected through Empress English and its one-on-one online lessons is processed in accordance with applicable Turkish data-protection legislation, including Law No. 6698 on the Protection of Personal Data (KVKK).

20. Refunds and Credits

Refunds and lesson credits are governed by my Refund & Credit Policy, together with any mandatory rights provided by applicable Turkish consumer legislation.

Nothing in these Terms & Conditions is intended to exclude or restrict a consumer right that cannot legally be excluded or restricted.

21. Limitation of Responsibility

I will provide one-on-one online English lessons with reasonable care and in accordance with the applicable lesson terms.

I am not responsible for circumstances that are outside my reasonable control or for outcomes that depend on decisions or actions of third parties.

This may include decisions made by examination organisations, universities, employers, immigration authorities, government institutions, professional licensing bodies, payment providers, communication platforms, or other independent organisations.

Nothing in these Terms & Conditions excludes or limits liability, consumer rights, or legal protections that cannot lawfully be excluded or limited under applicable Turkish law.

22. Events Beyond Reasonable Control

I will not be responsible for delays or failures in providing a lesson where caused by circumstances beyond my reasonable control.

Such circumstances may include serious technical failures, internet or infrastructure failures, natural disasters, government restrictions, widespread service outages, serious emergencies, or other events that could not reasonably have been prevented or overcome.

Where such an event affects a scheduled lesson, I will make reasonable efforts to provide an alternative lesson, credit, refund, or other appropriate solution depending on the circumstances and applicable law.

23. Changes to Lesson Arrangements

I may make reasonable changes to lesson content, lesson materials, schedules, website features, or lesson structures.

For lessons already purchased, I will not make material changes that substantially reduce the purchased service except where permitted or required by applicable law.

I may change prices, lesson packages, and lesson arrangements for future purchases.

24. Changes to These Terms & Conditions

I may update these Terms & Conditions from time to time to reflect changes to:

• One-on-one online lesson arrangements;

• Booking and payment procedures;

• Website functionality;

• Third-party service providers;

• Applicable legislation; or

• Regulatory requirements.

The latest version will be published on the Empress English website together with its effective date.

Changes will not remove or restrict mandatory rights applicable to an existing transaction.

25. Governing Law and Consumer Rights

These Terms & Conditions are governed by the laws of the Republic of Türkiye, to the extent permitted by applicable law.

Where a student is a consumer, mandatory consumer-protection provisions applicable to the transaction will continue to apply.

Nothing in these Terms & Conditions is intended to prevent a consumer from exercising rights granted by mandatory legislation or from applying to a competent consumer authority, consumer arbitration committee, or court where legally entitled to do so.

For international students, mandatory consumer protections that apply to the transaction under applicable law will not be excluded merely because the student resides outside Türkiye.

26. Severability

If any provision of these Terms & Conditions is found to be invalid, unlawful, or unenforceable, the remaining provisions will continue to apply to the extent permitted by law.

The invalid or unenforceable provision will be interpreted or replaced, where legally possible, in a manner that most closely reflects its original purpose without affecting mandatory legal rights.
